Omnilex summary

X. challenged the Geneva fee-tax commission’s decision confirming an attorney’s invoice of CHF 4,304 less an advance. The Federal Tribunal held that the remaining amount in dispute was below the threshold for an appeal in civil matters, so the filing could only be treated as a subsidiary constitutional complaint. Because the appeal did not identify any violated constitutional right and contained no sufficient reasoning, the court declared the matter inadmissible. The case was decided under the simplified procedure. No court costs were imposed, and the legal-aid request became moot.

Omnilex headnote

Art. 74 al. 1 let. b, 113 ss, 116, 117, 42 al. 2, 108 al. 1 LTF; subsidiary constitutional complaint against a cantonal decision on attorney’s fees. Where the residual value in dispute does not reach the minimum threshold for a civil-law appeal, only the subsidiary constitutional complaint is available. Such a remedy is limited to the allegation of constitutional rights and is subject to the strict duty of clear, specific reasoning under Art. 106 al. 2 LTF in conjunction with Art. 117 LTF. In the absence of any constitutionally framed and substantiated grievance, the Federal Tribunal does not enter into the matter and may proceed summarily under Art. 108(1) LTF. If no costs are levied, a request for legal aid becomes moot.

Objet
honoraires d'avocat,

66 al. 1 in fine LTF).

Extracted by Omnilex

Key legal question

Whether the appeal could be treated as a civil law appeal or only as a subsidiary constitutional complaint.

Extracted holding

Because the disputed amount was below the minimum value in dispute of CHF 30,000, the filing could only be examined as a subsidiary constitutional complaint.

Extracted reasoning

The residual amount in dispute before the lower authority was below the statutory threshold of Art. 74(1)(b) LTF.

Key legal question

Whether the constitutional complaint was sufficiently reasoned to permit review.

Extracted holding

The court could not enter into the complaint because it failed to identify and substantiate any violated constitutional right.

Extracted reasoning

A subsidiary constitutional complaint may invoke only constitutional rights, and such violations must be expressly raised and reasoned; the filing contained no such argumentation.

Key legal question

Whether court costs should be charged and whether the legal-aid request remained pending.

Extracted holding

No court costs were imposed; the request for legal aid became moot.

Extracted reasoning

Given the circumstances, the judgment was issued without costs under Art. 66(1) in fine LTF; as no costs were charged, the legal-aid request lost its purpose.
