Omnilex summary

The Federal Supreme Court did not enter into a constitutional complaint against a cantonal eviction decision because the appellant failed to pay the ordered cost advance even after the extension of time. The court applied Art. 62(3) BGG and dealt with the matter in the summary non-entry procedure under Art. 108(1)(a) BGG. Court costs of CHF 500 were charged to the appellant under Art. 66(1) BGG.

Omnilex headnote

Art. 62 Abs. 3 BGG; Art. 108 Abs. 1 lit. a BGG; non-payment of the cost advance after expiry of the extended time limit leads to non-entry in summary procedure. If the appellant fails to comply with the order to provide security for costs within the granted grace period, the complaint is inadmissible without substantive examination. Costs of the federal proceedings are borne by the unsuccessful party pursuant to Art. 66 Abs. 1 BGG.

Key legal question

Whether the constitutional complaint could be entered into despite non-payment of the required cost advance after the grace period.

Extracted holding

No; the complaint could not be entered into because the required advance was not paid within the extended deadline.
