Extracted by Omnilex

Key legal question

Whether the constitutional complaint is admissible despite non-payment of the advance costs within the extended deadline.

Extracted holding

The complaint is not admissible and cannot be entered upon because the ordered advance costs were not paid even after the grace period.

Extracted reasoning

Under Art. 62(3) BGG and the summary procedure of Art. 108(1)(a) BGG, failure to pay the advance costs within the extended deadline requires non-entry.

Key legal question

Allocation of court costs.

Extracted holding

Court costs are charged to the appellant under the causation principle.

Extracted reasoning

Because the appellant caused the non-entry by failing to pay the advance costs, costs are imposed on him pursuant to Art. 66(3) BGG.
