Omnilex summary

The Federal Supreme Court dealt with a filing labeled as an appeal against a cantonal decision awarding CHF 4,000 in costs. Because the amount in dispute was below the civil appeal threshold, the filing was treated as a subsidiary constitutional complaint. The Court held that the submission did not identify any constitutional right allegedly violated and contained no sufficiently reasoned constitutional grievance. It therefore declined to enter into the matter under the simplified procedure. The appellant was ordered to pay federal court costs of CHF 500, while no compensation was awarded to the respondent because no response had been requested.

Omnilex headnote

Composition
Mme la Juge Klett, présidente.
Greffier: M. Carruzzo.

Participants à la procédure
X.________,
recourant,

contre

Y.________, représentée par Me Pierre Heinis,
intimée.

Objet

Extracted by Omnilex

Key legal question

Admissibility of a subsidiary constitutional complaint against the costs award

Extracted holding

The filing could only be treated as a subsidiary constitutional complaint because the amount in dispute was below the civil appeal threshold.

Extracted reasoning

The remaining amount in dispute was below CHF 30,000, so ordinary civil appeal was unavailable.

Key legal question

Whether the complaint sufficiently invoked and substantiated a constitutional violation

Extracted holding

The complaint was inadmissible because it did not identify any constitutional right allegedly violated or provide the required reasoning.

Extracted reasoning

A subsidiary constitutional complaint may be heard only for alleged constitutional violations, and such grievances must be expressly raised and substantiated; the filing lacked any reference to a constitutional right.

Key legal question

Allocation of federal court costs

Extracted holding

The unsuccessful appellant must bear the federal court costs.

Extracted reasoning

As the recourse failed, costs were charged to the losing party; no response had been requested from the respondent, so no party compensation was due.
