X.________ Ltd. filed an English-language challenge against an ICC final award. After the Swiss Federal Supreme Court ordered it to submit the award and to appoint a Swiss service address, both under threat of non-entry, the appellant failed to comply within the deadline. The Court therefore declined to enter into the appeal in simplified procedure and waived court costs. The ruling was to be published in the Federal Gazette.

Omnilex headnote

Art. 42 Abs. 3 and 5 BGG; Art. 108 Abs. 1 lit. a BGG; failure to file the challenged decision and to designate a Swiss service address within the time limit results in non-entry. The court may, under threat of non-entry, require the appellant to submit the contested decision and to appoint a service address in Switzerland. If the defect is not cured within the set period, the appeal is dismissed from the docket in simplified proceedings. Under Art. 66 Abs. 1 second sentence BGG, court costs may exceptionally be waived in light of the circumstances.

Key legal question

Whether the appeal had to be entered into despite the appellant's failure to file the challenged award and to appoint a Swiss service address.

No. The appeal was not entered into because the appellant failed to comply with the court's order to submit the award and designate a Swiss service address within the deadline.

Under Art. 42(3) and (5) BGG, the court may require submission of the challenged decision and a Swiss service address; non-compliance triggers non-entry in the simplified procedure under Art. 108(1)(a) BGG.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were imposed in view of the circumstances.

Extracted reasoning

The court expressly waived the collection of court costs under Art. 66(1) second sentence BGG.
