Whether the employee's conduct on 7 July 2011 constituted just cause for immediate dismissal
The employee's physical aggression was serious, but the employer's prior hostile and harassing conduct had materially contributed to the incident; just cause was lacking.
A summary dismissal must be assessed in light of all circumstances, including the employer's own contractual breaches. Because the altercation arose in part from prolonged mobbing and the employer had not de-escalated the conflict, the employer could not rely on the consequences of its own wrongdoing.
