Omnilex summary

The Federal Supreme Court did not enter into the appellant’s civil appeal concerning moral damages against the respondent doctor. Legal aid had already been refused because the appeal lacked prospects of success, and the appellant then failed to pay the required advance on costs even after an additional deadline. The appeal was therefore manifestly inadmissible. Court costs of CHF 500 were charged to the appellant.

Omnilex headnote

Art. 62 cpv. 3, art. 48 cpv. 4 and art. 108 cpv. 1 lett. a LTF; inadmissibility for non-payment of advance costs. If the appellant does not timely pay the advance on costs after being granted an additional deadline, the Federal Supreme Court cannot enter into the appeal. The defect is not cured by the mere filing of the appeal. Where the appeal is manifestly inadmissible, the single judge may decide under the simplified procedure. Court costs follow the rule of defeat under art. 66 cpv. 1 LTF; legal aid is denied where the appeal lacks prospects of success (consid. 1-3).

Sentenza del 2 aprile 2012
I Corte di diritto civile

Composizione
Giudice federale Klett, Presidente,
Cancelliere Piatti.

Partecipanti al procedimento
A.________,
patrocinato dall'avv. Edy Grignola,
ricorrente,

contro

B.________,
patrocinato dall'avv. Filippo Ferrari,
opponente.

Oggetto
responsabilità del medico, torto morale;

ricorso contro la sentenza emanata il 3 agosto 2011
dalla II Camera civile del Tribunale d'appello del
Cantone Ticino.

Considerando:
che il 9 giugno 2010 il Pretore della giurisdizione di Locarno-Campagna ha respinto la petizione con cui A.________ ha chiesto di condannare il dott. B.________, già medico della defunta madre, a versargli fr. 60'000.-- a titolo di torto morale;
che con sentenza 3 agosto 2011 la II Camera civile del Tribunale di appello del Cantone Ticino ha respinto l'appello e la richiesta di assistenza giudiziaria dell'attore;
che A.________ ha inoltrato al Tribunale federale un ricorso in materia civile 13 settembre 2011 con cui postula l'accoglimento della petizione e della domanda di assistenza giudiziaria proposta nella seconda istanza cantonale, nonché di essere posto al beneficio dell'assistenza giudiziaria nella sede federale;
che con decreto 8 febbraio 2012 la Corte adita ha respinto la domanda di assistenza giudiziaria per carenza di possibilità di esito favorevole del ricorso e ha invitato il ricorrente a fornire entro il 28 febbraio 2012 un anticipo per le spese presunte del processo di fr. 2'500.--;
che il 6 marzo 2012 è stato impartito al ricorrente il termine suppletorio dell'art. 63 cpv. 3 LTF per effettuare il predetto pagamento entro il 21 marzo 2012;
che il 28 marzo 2012 la Cassa del Tribunale federale ha constatato che il richiesto anticipo spese non è stato pagato né accreditato sul suo conto postale e che non le è pervenuto alcun avviso di addebito di un conto bancario o postale;
che in queste circostanze il Tribunale federale non può entrare nel merito del ricorso (art. 48 cpv. 4 e 62 cpv. 3 LTF);
che pertanto il ricorso si rivela manifestamente inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata (art. 108 cpv. 1 lett. a LTF);
che le spese giudiziarie seguono la soccombenza (art. 66 cpv. 1 LTF);

per questi motivi, la Presidente pronuncia:

1.
Il ricorso è inammissibile.

2.
Le spese giudiziarie di fr. 500.-- sono poste a carico del ricorrente.

3.
Comunicazione ai patrocinatori delle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.

Extracted by Omnilex

Key legal question

Whether the civil appeal could be considered despite non-payment of the requested advance on costs.

Extracted holding

No. The court could not enter into the appeal because the advance on costs was neither paid nor credited within the extended deadline.

Extracted reasoning

Without payment of the advance, the procedural requirements for entering into the appeal were not met; the appeal was therefore manifestly inadmissible.

Key legal question

Whether the appellant was entitled to legal aid before the Federal Supreme Court.

Extracted holding

No. Legal aid was refused because the appeal lacked sufficient prospects of success.

Extracted reasoning

The court found the appeal had no reasonable chance of success, so the request for legal aid had to be denied.
