Omnilex summary

In a lease dispute, the appellant sought federal review of a Ticino appellate judgment annulling a notice to quit and rejecting eviction. After the Federal Supreme Court ordered an advance on costs and granted a supplementary deadline, no payment was made. The President therefore did not examine the merits and declared the appeal inadmissible in simplified procedure. Judicial costs of CHF 500 were charged to the appellant.

Sentenza del 15 ottobre 2009
I Corte di diritto civile

Composizione
Giudice federale Klett, Presidente,
Cancelliera Gianinazzi.

Parti
A.________,
patrocinato dall'avv. Carmelo Seminara,
ricorrente,

contro

B.________SA,
patrocinata dall'avv. Mauro Molo,
opponente.

Oggetto
contratto di locazione; disdetta, sfratto,

ricorso in materia civile contro la sentenza emanata
il 9 luglio 2009 dalla II Camera civile del Tribunale d'appello del Cantone Ticino.

Considerando:
che il 30 luglio 2009 A.________ è insorto dinanzi al Tribunale federale con un ricorso in materia civile volto a ottenere, previa concessione dell'effetto sospensivo al gravame, la modifica della sentenza emanata il 9 luglio 2009 dalla II Camera civile del Tribunale d'appello del Cantone Ticino nel senso dell'accoglimento dell'appello e, di conseguenza, accertata la nullità della disdetta, della reiezione dell'istanza di sfratto;
che con decreto del 31 luglio 2009 il ricorrente è stato invitato a fornire un anticipo delle spese di fr. 4'000.-- entro il 31 agosto 2009;
che, a seguito della richiesta formulata dal ricorrente in tal senso, questo termine è stato poi prorogato sino al 18 settembre 2009;
che, essendo tale termine scaduto infruttuoso, al ricorrente è stato fissato, giusta l'art. 62 cpv. 3 LTF, un termine suppletorio sino al 5 ottobre 2009, con l'avvertenza che in assenza di pagamento entro tale termine il rimedio sarebbe stato dichiarato inammissibile;
che in tempo utile non è intervenuto alcun versamento;
che in queste circostanze l'impugnativa non può essere vagliata nel merito (art. 62 cpv.3 LTF) e il ricorso, manifestamente inammissibile, può essere evaso mediante la procedura semplificata di cui all'art. 108 cpv. 1 lett. a e cpv. 2 LTF;

che, infine, le spese inutili sono sostenute dal ricorrente, che le ha cagionate (art. 66 cpv. 3 LTF);

per questi motivi, la Presidente pronuncia:

1.
Il ricorso è inammissibile.

2.
Le spese giudiziarie di fr. 500.-- sono poste a carico del ricorrente.

3.
Comunicazione ai patrocinatori delle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.

Key legal question

Whether the federal civil appeal was admissible despite non-payment of the required advance on costs after a supplementary deadline.

Extracted holding

No. Because the appellant did not pay the advance on costs within the supplementary time limit, the appeal could not be examined on the merits and had to be declared inadmissible.

Extracted reasoning

Under Art. 62(3) LTF, failure to pay the advance within the fixed supplementary deadline leads to inadmissibility. The case was therefore handled in simplified procedure under Art. 108(1)(a) and (2) LTF.

Key legal question

Who bears the judicial costs of the inadmissible appeal?

Extracted holding

The appellant bears the costs because he caused unnecessary expenses.

Extracted reasoning

Art. 66(3) LTF allows costs to be charged to the party that caused them.
