Omnilex summary

The Federal Supreme Court did not enter into the appeal against a cantonal decision withdrawing legal aid. The appellant's filing failed to satisfy the statutory reasoning requirements because it did not identify and substantiate any specific violation of rights. The court therefore declared the appeal inadmissible and ordered the appellant to pay court costs of CHF 500.

Omnilex headnote

Art. 42 Abs. 2, Art. 106 Abs. 2, Art. 108 Abs. 1 lit. b BGG; admissibility of a federal appeal and requirements of substantiation. An appeal to the Federal Supreme Court must, by reference to the reasoning of the challenged decision, set out which rights were violated; in matters involving constitutional rights, the Court examines complaints only if expressly raised and properly reasoned. A filing that does not meet these pleading requirements is not entered into under Art. 108 Abs. 1 lit. b BGG. Court costs are borne by the appellant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 24. Juni 2009
I. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Klett, Präsidentin,
Gerichtsschreiber Huguenin.

Parteien
A.________,
Beschwerdeführer,

gegen

Obergericht des Kantons Bern, Appellationshof, 1. Zivilkammer.

Gegenstand
Unentgeltliche Prozessführung,

Beschwerde gegen den Entscheid des Obergerichts
des Kantons Bern, Appellationshof, I. Zivilkammer,
vom 2. April 2009.

In Erwägung,
dass der Gerichtspräsident 2 des Gerichtskreises IV Aarwangen-Wangen die vom Beschwerdeführer gegen die Beschwerdegegnerin erhobene Aberkennungsklage mit Urteil vom 28. Oktober 2008 abwies;
dass der Beschwerdeführer gegen dieses Urteil am 7. November 2008 beim Obergericht des Kantons Bern Appellation einreichte;
dass das Obergericht mit Entscheid vom 2. April 2009 dem Beschwerdeführer das Recht zur unentgeltlichen Rechtspflege mit sofortiger Wirkung entzog;
dass der Beschwerdeführer dem Bundesgericht eine vom 5. Mai 2009 datierte Eingabe einreichte, aus der hervorgeht, dass er den Entscheid des Obergerichts vom 2. April 2009 mit Beschwerde in Zivilsachen anfechten will;
dass in einer Beschwerde an das Bundesgericht unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides dargelegt werden muss, welche Rechte der beschwerdeführenden Partei durch das kantonale Gericht verletzt worden sind (Art. 42 Abs. 2 BGG), wobei eine allfällige Verletzung der bundesrechtlichen Verfassungsrechte vom Bundesgericht nicht von Amtes wegen geprüft wird, sondern nur dann, wenn entsprechende Rügen in der Beschwerdeschrift ausdrücklich erhoben und begründet werden (Art. 106 Abs. 2 BGG);
dass die Eingabe des Beschwerdeführers vom 5. Mai 2009 diese Begründungsanforderungen offensichtlich nicht erfüllt, weshalb auf die Beschwerde mangels hinreichender Begründung nicht einzutreten ist (Art. 108 Abs. 1 lit. b BGG);
dass die Gerichtskosten dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 BGG);

erkennt die Präsidentin:

Auf die Beschwerde wird nicht eingetreten.

2.
Die Gerichtskosten von Fr. 500.-- werden dem Beschwerdeführer auferlegt.

3.
Dieses Urteil wird dem Beschwerdeführer und dem Obergericht des Kantons Bern, Appellationshof, I. Zivilkammer, schriftlich mitgeteilt.

Key legal question

Whether the federal appeal met the reasoning requirements for admissibility.

Extracted holding

The submission did not explain, with reference to the challenged decision, which rights had been violated and contained no explicit, substantiated constitutional complaints.

Extracted reasoning

A federal appeal must identify the alleged violations and reason them; the court does not examine constitutional rights ex officio.

Key legal question

Who bears the court costs of the federal proceedings.

Extracted holding

The court costs were imposed on the appellant.

Extracted reasoning

As the appeal was not entered upon, costs follow the outcome under the Federal Supreme Court Act.
