Omnilex summary

The appellant withdrew its appeal against the Zurich Higher Court decision in a tenancy dismissal/challenge dispute. The Federal Supreme Court therefore struck the proceedings off the docket. It ordered the appellant to pay court costs of CHF 1,500 and denied party compensation to the respondent, noting that the response caused no excessive effort and was drafted by the respondent’s employed lawyer.

Omnilex headnote

Art. 32 Abs. 2 BGG; withdrawal of the appeal leads to discontinuance of the proceedings. The withdrawing party bears the costs under Art. 66 BGG unless special reasons justify otherwise. Party compensation under Art. 68 Abs. 1 and 2 BGG is denied where the response does not entail substantial work and is prepared by an in-house employed lawyer, in line with established practice (consid. 1).
