Omnilex summary

The appellant filed a civil appeal against a Geneva fee-taxation decision. The Federal Supreme Court had first ordered an advance of costs of CHF 3,000 and later granted an extension under Art. 62(3) LTF, but the payment still was not made within the deadline. The President therefore held the appeal inadmissible for failure to pay the advance of costs and charged the appellant with a judicial fee of CHF 500.

Omnilex headnote

Art. 62 al. 3 LTF, art. 108 al. 1 let. a LTF; inadmissibility of an appeal for non-payment of the advance of costs. Where the appellant does not pay the required advance within the prescribed time limit, including any granted extension, the court shall not enter into the appeal. The failure to comply with the order to pay costs constitutes a procedural bar to review; the appeal is declared inadmissible by summary order. The court may charge judicial costs to the appellant (consid. 1).

Key legal question

Whether the civil appeal was admissible despite non-payment of the required advance of costs.

Extracted holding

No. The appeal was inadmissible because the required advance of costs was not paid within the prescribed time limit.

Extracted reasoning

The court noted that the advance of costs of CHF 3,000 was ordered, the deadline was extended under Art. 62(3) LTF, and payment still was not made in time; therefore the appeal had to be declared inadmissible under Art. 108(1)(a) LTF.

Key legal question

Allocation of court costs for the inadmissible appeal.

Extracted holding

A judicial fee of CHF 500 was charged to the appellant.

Extracted reasoning

As the appeal was inadmissible, the costs were imposed on the appellant.
