Omnilex summary

X. appealed a Solothurn tax judgment concerning state and federal taxes for 2005, but her lawyer later withdrew the appeal. The Federal Supreme Court, acting by order of the presiding judge, discontinued the proceedings. It ordered the appellant to pay CHF 200 in court costs and denied any party compensation. The order was communicated to the appellant, the cantonal tax office, the cantonal tax court, and the Federal Tax Administration.

Omnilex headnote

Art. 32 Abs. 2 BGG; withdrawal of the appeal leads to discontinuance by order of the instruction judge; in such a case the federal court costs are borne by the withdrawing appellant pursuant to Art. 66 Abs. 1 and 3 BGG, and no party compensation is awarded under Art. 68 Abs. 1 and 2 BGG. The discontinuance is procedural only and does not entail a merits review of the challenged judgment.
