Omnilex summary

X.________ challenged a cantonal order approving detention in view of removal. He informed the Federal Tribunal that he had been released before the federal decision. The court held that the release removed any legally protected interest, so the complaint was manifestly inadmissible under the simplified procedure. Despite the appellant's failure, the court waived judicial costs in light of the circumstances.

Omnilex headnote

Art. 108 al. 1 let. a LTF; admissibility of a complaint after the contested detention has ended. Once the appellant has been released from detention, the legally protected interest in obtaining judicial review of the detention measure falls away, absent a specific current interest justifying exception. The complaint is therefore manifestly inadmissible and may be disposed of in simplified procedure under Art. 108 LTF, without an exchange of pleadings. Costs may exceptionally be waived under Art. 66 al. 1 LTF when the circumstances so justify.

Arrêt du 19 août 2008
IIe Cour de droit public

Composition
M. le Juge Merkli, Président.
Greffière: Mme Charif Feller.

Parties
X.________,
recourant,

contre

Service de la population et des migrations
du canton du Valais.

Objet

Key legal question

Whether the complaint against the detention-for-removal decision remained admissible after the appellant's release.

Extracted holding

The complaint was inadmissible because the appellant no longer had a legally protected interest once he had been released.

Extracted reasoning

The appellant stated that he had been released on 2008-07-30. As a result, the legally protected interest required for review was absent, making the complaint manifestly inadmissible under the simplified procedure.

Key legal question

Whether court costs should be charged despite the appellant's failure.

Extracted holding

Although costs would ordinarily be borne by the unsuccessful appellant, the court decided to waive court costs in view of the circumstances.

Extracted reasoning

Under Art. 66 para. 1 LTF, costs may be waived exceptionally; the court exercised that discretion here.
