Omnilex summary

The Federal Supreme Court dealt with a second filing by X.________ AG in the same tax matter after it had already issued a non-entry decision in case 2C_55/2012. The court warned the company that, absent clarification, the newly opened proceeding would be closed without costs. As the appellant did not react, the President ordered case 2C_120/2012 struck out and waived court costs. The decision was communicated to the parties, the cantonal administrative court and the federal tax administration.

Omnilex headnote

Art. 32 Abs. 2 and Art. 66 Abs. 1 second sentence BGG; duplicate federal appeal filed after an earlier non-entry decision and no response to the court's warning: where a party, after being invited to clarify whether it persists in the matter, remains silent, the court may strike the proceedings off the roll without costs (consid. 2). The procedure is discontinued ex officio on the basis of the manifest lack of need for adjudication; a cost order is omitted in the announced constellation.

2C_120/2012

Verfügung vom 24. Februar 2012
II. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Zünd, Präsident,
Gerichtsschreiber Feller.

Verfahrensbeteiligte
X.________ AG,
Beschwerdeführerin,

gegen

Kantonales Steueramt Zürich,
Dienstabteilung Recht, Postfach, 8090 Zürich.

Gegenstand
Staats- und Gemeindesteuern 1.7.2005 - 30.6.2006 (Revision des Urteils des Verwaltungsgerichts des Kantons Zürich vom 3.3.2010),

Beschwerde gegen das Urteil des Verwaltungsgerichts des Kantons Zürich, 2. Kammer,
vom 30. November 2011.

1.
Das Verfahren 2C_120/2012 wird abgeschrieben.

2.
Es werden keine Kosten erhoben.

3.
Diese Verfügung wird den Verfahrensbeteiligten, dem Verwaltungsgericht des Kantons Zürich, 2. Kammer, und der Eidgenössischen Steuerverwaltung schriftlich mitgeteilt.

Lausanne, 24. Februar 2012
Im Namen der II. öffentlich-rechtlichen Abteilung
des Schweizerischen Bundesgerichts
