Omnilex summary

S. filed a constitutional complaint against the Zug Criminal Court of Appeal. The Federal Supreme Court had ordered a CHF 1,000 advance of costs and warned that failure to pay would result in non-entry. The advance was neither paid nor was any request for extension or fee waiver submitted within the deadline. The court therefore declined to enter into the complaint and charged the complainant with the federal court fee of CHF 500.

Omnilex headnote

Art. 150 Abs. 4 OG; Art. 156 Abs. 1 OG; non-payment of the ordered cost advance and absence of any timely request for extension or exemption leads to non-entry into the constitutional complaint. Where the appellant remains inactive despite explicit warning, the court must refuse to examine the merits. In such a case, federal costs are borne by the complainant.

Strafverfahren,

Staatsrechtliche Beschwerde gegen das Urteil des Strafgerichts des Kantons Zug, Berufungskammer, vom 21. Juni 2002.

Das Bundesgericht zieht in Erwägung:
1.
S.________ erhob am 8. August 2002 staatsrechtliche Beschwerde gegen das Urteil der Berufungskammer des Strafgerichts des Kantons Zug vom 21. Juni 2002. Das Bundesgericht forderte ihn mit Schreiben vom 12. August 2002 u.a. auf, bis zum 10. Extracted by Omnilex

Key legal question

Whether the constitutional complaint was admissible despite the unpaid cost advance and no request for extension or fee exemption

Extracted holding

The complaint could not be examined because the required cost advance was not paid in time and no extension or exemption request was filed.

Extracted reasoning

After the court warned that failure to pay the CHF 1,000 advance by 10 September 2002 would lead to non-entry, the complainant remained inactive. Under Art. 150 Abs. 4 OG, the court therefore had to decline entry.

Key legal question

Who bears the federal court costs

Extracted holding

The complainant must bear the federal court costs.

Extracted reasoning

Because the complaint was not entered into, the losing party had to pay costs under Art. 156 Abs. 1 OG.
