1P.369/2001Federal Supreme Court / Public Law Division IOct 4, 2001Inadmissible

Omnilex summary

B.________ filed a constitutional complaint against a decision of the Zurich Court of Cassation concerning refusal to admit an indictment. He asked the Federal Supreme Court to suspend the proceedings so that he could file a supplementary submission later. The court held that the complaint period is statutory and cannot be extended, that no supplement was filed in time, and that the complaint did not satisfy the substantiation requirements. It therefore declined to enter into the complaint and waived court costs.

Omnilex headnote

Art. 33 Abs. 1 OG; Art. 90 Abs. 1 lit. b OG; Art. 36a OG; a constitutional complaint must be substantiated within the statutory time limit, which cannot be extended by a request for suspension or later supplementation. If no compliant submission is filed within the deadline, the Federal Supreme Court does not enter into the matter; a cost order may be waived where it would serve no purpose.

Extracted by Omnilex

Key legal question

Whether the constitutional complaint was admissible despite the request for suspension and later supplementation.

Extracted holding

The complaint could not be supplemented after the statutory time limit, and the filing did not satisfy the formal requirements for a constitutional complaint.

Extracted reasoning

The complaint period is a statutory deadline that cannot be extended. No supplement was filed within 30 days, and the submission did not meet Art. 90(1)(b) OG.

Key legal question

Whether court costs should be imposed.

Extracted holding

No costs were charged because a cost order would have been pointless in the circumstances.

Extracted reasoning

The court considered a cost assessment futile.
