Omnilex summary

The appellant challenged the cantonal dismissal of his complaint following the discontinuance of a criminal investigation arising from a police intervention. The Federal Supreme Court held that requests going beyond annulment were inadmissible. It also declined to enter into the blanket recusal request against the entire court, finding it abusive and unsubstantiated. The constitutional complaint itself was inadmissible because the appellant did not sufficiently show a violation of constitutional rights. Court costs of CHF 500 were imposed on him.

Omnilex headnote

Art. 90 Abs. 1 OG, Art. 88 OG; admissibility of a constitutional complaint and recusal request. A constitutional complaint must, in principle, seek annulment only; requests extending beyond that are inadmissible. A general recusal request against the entire court is abusive if it does not specify concrete grounds of bias for each judge. Under Art. 88 OG, standing to complain exists only to the extent of infringement of personal constitutional rights; the appellant must specifically and substantiatedly show such a violation. Mere criticism of the merits of the discontinuance decision is insufficient (consid. 3-5).

Urteil vom 26. März 2007
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Féraud, Präsident,
Bundesrichter Aeschlimann, Reeb,
Gerichtsschreiber Bopp.

Parteien
X.________, Beschwerdeführer,

gegen

Staatsanwaltschaft Graubünden, Sennhofstrasse 17, 7001 Chur,
Kantonsgericht von Graubünden, Beschwerdekammer, Poststrasse 14, 7002 Chur.

Gegenstand
Strafanzeige,

Juli 2006.

Das Bundesgericht zieht in Erwägung:
1.

6.
Dem Verfahrensausgang entsprechend sind die bundesgerichtlichen Kosten dem Beschwerdeführer aufzuerlegen sind (Art. 153, 153a und 156 Abs. 1 OG);

Demnach wird im Verfahren
nach Art. 36a OG erkannt:
1.
Auf das Ausstandsbegehren wird nicht eingetreten.
2.
Auf die staatsrechtliche Beschwerde wird nicht eingetreten.
3.

Key legal question

Whether requests seeking more than annulment of the cantonal decision were admissible.

Extracted holding

They were inadmissible from the outset.

Extracted reasoning

A constitutional complaint cannot seek relief beyond the annulment of the challenged decision.

Key legal question

Whether the blanket request to recuse the entire Federal Supreme Court was admissible.

Extracted holding

It was not admissible because it was abusive and lacked individualized reasons for bias.

Extracted reasoning

The request did not set out concretely why each member of the court should be considered biased.

Key legal question

Whether the constitutional complaint satisfied the requirements of standing and reasoning.

Extracted holding

It did not; the complaint lacked sufficient substantiation of a violation of constitutional rights.

Extracted reasoning

The appellant, even assuming standing regarding possible procedural rights, did not explain in what way the cantonal decision violated his constitutional rights.
