Omnilex summary

The applicant sought revision of a prior Federal Supreme Court non-entry judgment. The Court held that revision of a final federal judgment is possible only if a statutory ground under Art. 121 ff. BGG is shown. The filing of 21 March 2011 merely criticized the prior legal reasoning and did not identify any revision ground. The Court therefore did not enter on the revision request and, exercising discretion, waived court costs under Art. 66 para. 1 BGG.

Omnilex headnote

Art. 121 ff. BGG, Art. 127 BGG; revision of a final Federal Supreme Court judgment is admissible only if a statutory revision ground is specifically substantiated. Mere disagreement with the legal assessment in the earlier judgment is not a revision ground. If the filing fails to indicate any cognizable ground, the Court will not enter into the request; a written exchange may be dispensed with where the application is manifestly insufficient. Cost allocation remains subject to Art. 66 para. 1 BGG.
