Omnilex summary

X.________ challenged a cantonal administrative judgment concerning compensation for seized weapons and accessories. The Federal Supreme Court held that the complaint was only framed in general terms and did not concretely show why the reasoning or result of the non-entry decision was unlawful. Because the substantiation requirements were not met, the Court dealt with the matter summarily and did not enter into the complaint. No court costs were imposed.

Omnilex headnote

Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG; requirement of substantiated reasoning in the federal complaint. A complaint must, in relation to the contested reasoning, set out in a focused manner why the decision infringes federal law or constitutional rights; merely general criticism of the judgment, the authorities or the factual background is insufficient. If the deficiency is obvious, the Federal Supreme Court may decide in simplified procedure under Art. 108 Abs. 1 BGG. Under Art. 66 Abs. 1 BGG, costs may be waived where the circumstances so justify.

Besetzung
Bundesrichter Féraud, Präsident,
Gerichtsschreiber Bopp.

Parteien
X.________,
Beschwerdeführer,

gegen

Polizei- und Militärdirektion des Kantons Bern, 3011 Bern.

Gegenstand
Entschädigung für eingezogene Waffen und für Waffenzubehör,

Beschwerde gegen das Urteil des Verwaltungsgerichts des Kantons Bern, Verwaltungsrechtliche Abteilung, vom 3. August 2009.

In Erwägung,
dass der Einzelrichter der Verwaltungsrechtlichen Abteilung des Verwaltungsgerichts des Kantons Bern mit Urteil vom 3. August 2009 auf eine von X.________ erhobene Beschwerde nicht eingetreten ist;
dass X.________ gegen dieses Urteil öffentlich-rechtliche Beschwerde ans Bundesgericht führt;
dass das Bundesgericht davon abgesehen hat, Vernehmlassungen einzuholen;
dass der Beschwerdeführer das angefochtene Urteil sowie verschiedene Behörden und Geschehnisse ganz allgemein kritisiert, dabei aber nicht darlegt, inwiefern die dem Nichteintretensentscheid zugrunde liegende Begründung bzw. der Entscheid im Ergebnis rechts- bzw. verfassungswidrig sein soll;
dass die Beschwerde daher den gesetzlichen Formerfordernissen (Art. 42 Abs. 2 und Art. 106 Abs. 2 BGG, s. in diesem Zusammenhang BGE 134 I 313 E. 2 S. 315 sowie 134 II 349 E. 3 S. 351 f.; 133 II 249 insb. E. 1.4 S. 254) nicht zu genügen vermag, weshalb auf sie nicht einzutreten ist;
dass der genannte Mangel offensichtlich ist, weshalb über die Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 BGG entschieden werden kann;
dass es sich bei den gegebenen Verhältnissen rechtfertigt, keine Kosten zu erheben (Art. 66 Abs. 1 BGG);

wird erkannt:

1.

3.
Dieses Urteil wird dem Beschwerdeführer sowie der Polizei- und Militärdirektion und dem Verwaltungsgericht des Kantons Bern, Verwaltungsrechtliche Abteilung, schriftlich mitgeteilt.

Key legal question

Whether the federal complaint met the admissibility requirements, in particular the duty to substantiate the challenge under Art. 42(2) and Art. 106(2) BGG.

Extracted holding

The complaint did not explain why the reasoning of the non-entry decision or its outcome would be unlawful or unconstitutional, so the statutory reasoning requirements were not met.

Extracted reasoning

The filing contained only general criticism of the judgment, authorities, and events, without a targeted legal argument against the challenged reasoning. The defect was obvious, allowing summary treatment under Art. 108(1) BGG.

Key legal question

Whether court costs should be charged.

Extracted holding

No costs were imposed in light of the circumstances.

Extracted reasoning

The court considered the circumstances to justify waiving costs under Art. 66(1) BGG.
