Omnilex summary

The Federal Supreme Court did not enter into the appellant’s challenge against the Federal Administrative Court’s judgment annulling his facilitated naturalization. It held that the submission only contained general criticism and failed to meet the mandatory reasoning requirements under the Federal Supreme Court Act. Because the defect was obvious, the case was decided in simplified procedure. The appellant was ordered to pay court costs of CHF 500.

Omnilex headnote

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 Abs. 1 BGG; admissibility and reasoning requirements of a public law appeal. An appeal must set out, in a manner tailored to the contested grounds, why the challenged decision is unlawful; a merely general criticism of the judgment is insufficient. In complaints alleging constitutional or fundamental-rights violations, the appellant must plead and substantiate the alleged infringement expressly and with precision. If the deficiency is manifest, the Federal Supreme Court may decide summarily and decline to enter into the matter (consid. 1). Under Art. 66 Abs. 1 BGG, costs are borne by the unsuccessful party.

In Erwägung,
