Omnilex summary

X appealed to the Federal Supreme Court against a cantonal administrative judgment concerning a building permit. The Federal Supreme Court held that the appeal was filed one day after the 30-day deadline had expired, since service occurred on 25 May 2009 and the period ran from the following day until 24 June 2009. The court therefore did not enter into the appeal in simplified proceedings. Court costs of CHF 500 were imposed on X.

Omnilex headnote

Art. 100 Abs. 1, Art. 44 Abs. 1 and Art. 108 Abs. 1 lit. a BGG; late filing of a federal appeal. The 30-day appeal period begins on the day after service of the complete judgment and expires accordingly at the end of the last day of the period. A complaint lodged after expiry is manifestly inadmissible and may be dealt with without exchange of pleadings in simplified proceedings. Costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Gegenstand

Beschwerde gegen den Entscheid vom 6. Mai 2009
des Verwaltungsgerichts des Kantons Zürich,

  1. Abteilung, 1. Kammer.
    Erwägungen:

1.
Das Verwaltungsgericht des Kantons Zürich wies mit Entscheid vom 6. Mai 2009 eine Beschwerde von X.________ ab.

2.
