Omnilex summary

The appellant challenged a Federal Administrative Court judgment concerning annulment of naturalization but failed to submit the appealed decision despite a warning and also failed to provide adequate reasoning. The Federal Supreme Court therefore did not enter into the appeal in simplified proceedings. It further denied the request for free legal aid because the case had no prospects of success and waived court costs.

Omnilex headnote

Art. 42 Abs. 2 and 5 BGG, Art. 64 Abs. 1 BGG, Art. 66 Abs. 1 BGG; non-entry on an appeal for failure to submit the contested decision and for insufficient reasoning. If the appellant does not cure a formal defect after a court order, the written submission remains disregarded. A complaint must specifically indicate how the challenged decision violates federal law; a merely conclusory or incomprehensible submission does not satisfy the statutory reasoning requirement. Where the appeal is manifestly devoid of prospects, legal aid is to be refused; costs may nonetheless be waived in view of the circumstances (consid. 1).

Urteil vom 28. April 2009
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Féraud, Präsident,
Gerichtsschreiber Pfäffli.

Parteien
X.________, Beschwerdeführer,

gegen

Bundesamt für Migration, Quellenweg 6, 3003 Bern.

Gegenstand
Nichtigerklärung der Einbürgerung,

Beschwerde gegen das Urteil vom 3. März 2009
des Bundesverwaltungsgerichts, Abteilung III.
In Erwägung,
dass X.________ mit Eingabe vom 9. April 2009 Beschwerde gegen das Urteil des Bundesverwaltungsgerichts, Abteilung III, vom 3. März 2009 erhoben hat;
dass das angefochtene Urteil der Beschwerde nicht beilag;
dass das Bundesgericht den Beschwerdeführer unter Hinweis auf Art. 42 Abs. 5 BGG mit Verfügung vom 14. April 2009 aufgefordert hat, bis spätestens am 27. April 2009 den angefochtenen Entscheid des Bundesverwaltungsgerichts vom 3. März 2009 beim Bundesgericht einzureichen, ansonsten die Rechtsschrift unbeachtet bliebe;
dass die als Gerichtsurkunde versandte Verfügung nach Ablauf der Abholfrist mit dem Vermerk "Nicht abgeholt" an das Bundesgericht zurückgesandt wurde;
dass die Verfügung gemäss Art. 44 Abs. 2 BGG als zugestellt gilt;
dass der Beschwerdeführer den angefochtenen Entscheid innert Frist nicht eingereicht hat;
dass die Beschwerde auch den Begründungsanforderungen von Art. 42 Abs. 2 BGG nicht entspricht, da sich aus ihr nicht ergibt, inwiefern der angefochtene Entscheid Recht im Sinne dieser Bestimmung verletzen sollte;
dass daher im vereinfachten Verfahren nach Art. 108 BGG auf die Beschwerde nicht einzutreten ist;
dass angesichts der Aussichtslosigkeit des Verfahrens dem Gesuch um unentgeltliche Rechtspflege nicht zu entsprechen ist (Art. 64 Abs. 1 BGG), auf eine Kostenauflage indessen verzichtet werden kann (Art. 66 Abs. 1 BGG);

erkennt der Präsident:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Das Gesuch um unentgeltliche Rechtspflege wird abgewiesen.

Key legal question

Whether the appeal could be entered despite the missing appealed decision and deficient reasoning.

Extracted holding

The appeal could not be entered because the appellant failed to file the appealed decision within the set deadline and the complaint did not meet the statutory reasoning requirements.

Extracted reasoning

After a warning under Art. 42(5) BGG, the appellant still did not submit the contested judgment. The complaint also failed to explain in what respect the challenged decision violated federal law under Art. 42(2) BGG. The simplified procedure under Art. 108 BGG therefore required non-entry.

Key legal question

Whether the appellant was entitled to free legal aid.

Extracted holding

Free legal aid was denied because the proceedings lacked prospects of success.

Extracted reasoning

Given the obvious inadmissibility of the appeal, the application was prospectless within the meaning of Art. 64(1) BGG.

Key legal question

Whether court costs should be imposed.

Extracted holding

No court costs were charged.

Extracted reasoning

The Court waived costs under Art. 66(1) BGG despite the unsuccessful filing.
