Omnilex summary

The Federal Supreme Court recorded the withdrawal of the public-law appeal in a spatial-planning case and removed the proceedings from the docket. The appellants accepted that the private respondents should receive CHF 1,000 in party compensation. The Court ordered the appellants to pay court costs of CHF 500 and the agreed compensation. The cantonal judgment was not reviewed on the merits.

Omnilex headnote

Art. 32 Abs. 2 BGG; withdrawal of an appeal before the Federal Supreme Court renders the proceedings moot and leads to striking off the case. The withdrawing appellants bear the court costs under Art. 66 Abs. 1 BGG. Private respondents are entitled to appropriate party compensation under Art. 68 Abs. 2 BGG; where the parties agree on the amount, the Court may adopt that amount without merits review.

Key legal question

Whether the appeal proceedings should be struck from the docket after withdrawal of the appeal.

Extracted holding

The appeal proceedings were discontinued and struck out because the appellants withdrew the appeal.

Extracted reasoning

Once the appeal had been withdrawn, the dispute became moot for the Federal Court, so the case had to be removed from the register under Art. 32(2) BGG.

Key legal question

Who bears the court costs after the withdrawal of the appeal?

Extracted holding

The appellants must pay the court costs.

Extracted reasoning

Costs follow the outcome of the proceedings; after withdrawal, the appellants are treated as the losing party for costs purposes under Art. 66(1) BGG.

Key legal question

Whether the appellants must pay party compensation to the private respondents.

Extracted holding

The appellants must pay party compensation of CHF 1,000 in total to the private respondents.

Extracted reasoning

The private respondents were entitled to an appropriate party indemnity under Art. 68(2) BGG, and the parties agreed to the amount.
