Omnilex summary

The appellant challenged a cantonal decision declaring his request for recusal of an investigating judge inadmissible as late. Before the Federal Tribunal, he filed a poorly reasoned appeal that did not address the decisive lateness ground. Applying the requirement that all independent grounds of the contested decision be challenged, the Court held the appeal manifestly insufficient and inadmissible in summary procedure. As the appellant failed, the Court also ordered him to pay CHF 500 in judicial costs.

Omnilex headnote

Art. 42 al. 1-2 LTF, art. 108 al. 1 let. b LTF; admissibility of an appeal against a decision based on several independent grounds. When the contested decision is supported by multiple independent and sufficient reasons, the appellant must demonstrate, in a reasoned manner, that each of those grounds is unlawful; otherwise the appeal is inadmissible. An appeal that omits any challenge to a decisive ground, in particular the principal ground of the cantonal authority, is manifestly insufficiently reasoned and may be dismissed in simplified procedure. The unsuccessful appellant bears the judicial costs under arts. 65 al. 1 and 66 al. 1 LTF.

Arrêt du 10 décembre 2007
Ire Cour de droit public

Composition
M. le Juge Féraud, Président.
Greffier: M. Jomini.

Parties
A.________,
recourant,

contre

B.________, Juge d'instruction, Office du Juge d'instruction du Bas-Valais,
intimée.

Objet

Extracted by Omnilex

Key legal question

Whether the appeal sufficiently challenged the cantonal president's independent ground of late filing.

Extracted holding

No. Because the appellant did not contest the principal ground that the recusal request was filed too late, the appeal was manifestly insufficient.

Extracted reasoning

Where a decision rests on several independent and sufficient grounds, the appellant must show that each ground violates the law; failing to address one decisive ground renders the appeal inadmissible under simplified procedure.

Key legal question

Whether court costs should be imposed on the unsuccessful appellant.

Extracted holding

Yes. The losing appellant must bear the judicial costs.

Extracted reasoning

Under the LTF cost provisions, the unsuccessful party bears the costs.
