Omnilex summary

The complainant sought an immediate precautionary order from the Federal Supreme Court in connection with a criminal complaint. The court found that neither the filing nor its attachments showed any appealable decision, and the complaint also failed to indicate a legal violation as required. It therefore did not enter into the matter in simplified proceedings. The request for interim measures became moot, and no court costs were charged.

Omnilex headnote

Art. 42 Abs. 2 BGG, Art. 108 Abs. 1 BGG; inadmissibility of a complaint where no appealable decision is identifiable and the submission does not substantiate a violation of law. The Federal Supreme Court may refuse entry in simplified proceedings when the challenged act cannot be determined from the pleadings or annexes and the duty to state reasons is not met. A request for interim measures falls away once the main matter is not entered into. Costs may be waived under Art. 66 Abs. 1 BGG.

Urteil vom 14. Juni 2010
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Féraud, Präsident,
Gerichtsschreiber Pfäffli.

Verfahrensbeteiligte
X.________, Beschwerdeführer,

gegen

Unbekannten Beschwerdegegner.

Gegenstand
Strafverfahren.
Erwägungen:

1.

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Kosten erhoben.

3.
Dieses Urteil wird dem Beschwerdeführer schriftlich mitgeteilt.

Lausanne, 14. Juni 2010
Im Namen der I. öffentlich-rechtlichen Abteilung
des Schweizerischen Bundesgerichts
