Omnilex summary

X.________ challenged a notification of surveillance measures by the Federal Prosecutor and, out of caution, filed a parallel complaint with the Federal Supreme Court after filing before the Federal Criminal Court's complaint chamber. Because that chamber had already confirmed its jurisdiction and dismissed the complaint on the merits, the Supreme Court found the precautionary complaint inadmissible under the simplified procedure. It also waived court costs.

Omnilex headnote

Art. 108 Abs. 1 lit. a BGG; inadmissibility of a precautionary complaint where another competent authority has already decided the matter; once the lower complaint authority has affirmed jurisdiction and rendered a merits decision, there is no basis for direct review by the Federal Supreme Court. Costs may be waived under Art. 66 Abs. 1 BGG in the circumstances of inadmissibility.
