Omnilex summary

The appellant challenged the Federal Prosecutor’s notification of surveillance measures and, out of caution, filed an identical appeal directly with the Federal Supreme Court while the Federal Criminal Court’s complaints chamber was also seised. After that chamber held itself competent and dismissed the complaint, the Federal Supreme Court held that the precautionary appeal was not receivable under the simplified procedure. No court costs were charged.

Omnilex headnote

Art. 108 Abs. 1 lit. a BGG; inadmissibility of an appeal where the matter has already been decided by the competent lower complaints chamber. If a party files a precautionary direct appeal to the Federal Supreme Court solely because it doubts the competence of the lower instance, the appeal becomes moot once that instance has affirmed jurisdiction and ruled on the merits. In such a situation, the President may decide not to enter into the matter in simplified procedure. Costs may be waived under Art. 66 Abs. 1 BGG.
