Der Rekursbeklagte J. Vogt trägt auf Abweisung des Rekurses an, indem er ebenfalls die Einwendung der Verspätung vorschützt und im weitern, unter Bestreitung der thatsächlichen Behauptungen des Rekurrenten, darzuthun sucht, daß die Beschwerde auch materiell durchaus unbegründet sei.
