The Federal Court stated that a new psychiatric evaluation had to be examined because the defendant's responsibility was relevant both to sentencing and to possible detention. It added that if full insanity were established, punishment and detention under Art. 42 StGB would be excluded, leaving only measures under Arts. 14 or 15 StGB. The excerpt also notes that a contrary wording in an earlier Federal Court judgment was due to an error and must be corrected.
Art. 13 StGB; assessment of criminal responsibility and consequences of full insanity; where the extent of responsibility is unclear, a new psychiatric expert opinion must be considered. Full incapacity of responsibility excludes punishment under Art. 10 StGB and also preventive detention under Art. 42 StGB; in that event only protective measures under Arts. 14 or 15 StGB come into consideration. An earlier divergent formulation in a published judgment was a clerical error and must be corrected.

Aus den Erwägungen:
Vorab stellt sich sowohl im Hinblick auf die Strafe wie auf die Verwahrung die Frage einer neuen psychiatrischen Begutachtung (Art. 13 StGB). Bei völliger Unzurechnungsfähigkeit, die allerdings wenig wahrscheinlich ist, wäre der Beschwerdeführer nicht strafbar (Art. 10 StGB), und das würde auch seine Verwahrung nach Art. 42 StGB ausschliessen. In Betracht käme diesfalls nur eine Massnahme nach Art. 14 oder 15 StGB. Die anderslautende Fassung des Urteils des Kassationshofes vom 23. Dezember 1960 i.S. Trachsler, veröffentlicht in BGE 86 IV 204, beruht auf einem Versehen und ist zu berichtigen.
