Il faut d'abord rechercher quel était l'état de la technique lors du dépôt du brevet litigieux, puisque c'est au regard de cette situation qu'on doit juger si le dispositif breveté a réalisé un progrès technique nettement établi et procédait d'une idée créatrice d'un niveau suffisamment élevé.

Une antériorité peut consister, selon l'art. 4 LBI de 1907, dans une réalisation ou une publication antérieure ignorée ou complètement oubliée des techniciens. Cette disposition légale introduit donc, en matière de nouveauté, une notion de l'état de la technique qui est une pure fiction (cf. BLUM/PEDRAZZINI, Das schweizerische Patentrecht, I, ad art. 7 rem. 6, p. 342; TROLLER, Immaterialgüterrecht, I, p. 202 et suiv.).

Il n'en est pas de même dans le domaine du progrés technique et du niveau inventif. Ici, l'état de la technique s'apprécie selon les connaissances effectives des hommes du métier. On ne doit tenir compte d'une invention antérieure que si elle a réellement exercé une influence sur le développement de la technique. Lors donc que, par exemple, une publication n'a pas été divulguée ou est tombée dans l'oubli, on ne peut la prendre en considération pour juger si l'objet d'un brevet litigieux constitue une invention (MATTER, Aktuelle Fragen aus dem Gebiet des Patent- und des Patentprozessrechtes, dans RDS 1944 p. 30 a; TROLLER, op.cit., p. 199).
