Sachverhalt

Motta beauftragte seinen Anwalt, gegen H. eine Schadenersatzklage einzuleiten. Er übergab ihm zum Belege der Forderung drei Schreiben, die inhaltlich nicht den Tatsachen entsprachen und ausschliesslich zur Verwendung im Prozess angefertigt worden waren.

Das Schwurgericht des Kantons Zürich verurteilte Motta wegen Urkundenfälschung. Es legte ihm zur Last, einen unrechtmässigen Vorteil erstrebt zu haben; er habe mit den Falsifikaten seine Gewinnchancen im Prozess erhöhen wollen.

Motta führt Nichtigkeitsbeschwerde. Er bestreitet die Unrechtmässigkeit des Vorteils.

Erwägungen

Aus den Erwägungen:

HAFTER, auf den sich die Beschwerde beruft, hält dafür, dass eine Fälschung, mit der die Befriedigung eines zu Recht bestehenden Anspruchs bewirrkt werden solle, straflos bleiben müsse (Lehrbuch, Bes. Teil, II S. 600, Anm. 3). Er stützt sich dabei auf ein in der I. Expertenkommission abgegebenes Votum (Prot. I. Exp.Kom. 2, 116, Votum v. Schumacher). Darauf kann jedoch nicht abgestellt werden, weil sich zwei weitere Votanten derselben Kommission in gegenteiligem Sinne äusserten, indem sie zum Ausdruck brachten, dass auch derjenige in rechtswidriger Absicht handle, der zum Beweis eines ihm zustehenden Rechtes eine falsche Urkunde anfertige (Prot. I. Exp.Kom. 2, 118, Voten Weber und Stooss), was in der Folge unwidersprochen blieb. In der Tat hat, wer den ihm obliegenden Beweis im Zivilprozess mit erlaubten Mitteln nicht erbringen kann, die Folgen auf sich zu nehmen, selbst wenn dadurch sein materielles Recht verletzt wird. Es steht ihm nicht zu, durch Anfertigung falscher Urkunden die Beweislage zu seinen Gunsten zu verändern und seine Gewinnchancen im Prozess auf diese Weise zu erhöhen. Das widerspräche dem Interesse des Staates an einer zuverlässigen Rechtsprechung (vgl.BGE 78 IV 90). Wer solches unternimmt, erstrebt daher einen unrechtmässigen Vorteil, und zwar unbekümmert darum, ob der im Streite liegende Rechtsanspruch begründet ist oder nicht.
