Omnilex summary

In cassation, Morger argued that his willingness to renounce driving a motor vehicle should support a conditional sentence. The court held that such a promise does not remove doubts about future good conduct, especially when made from fear of punishment rather than reform. It further held that a judicial instruction under Art. 41 no. 2 StGB may only support a defendant who already satisfies the requirements for conditional release and cannot be used to obtain conditional punishment for an offender who does not merit it.

Omnilex headnote

Art. 41 Ziff. 1 Abs. 2 and Ziff. 2 StGB; conditional sentence and judicial instruction: a mere promise of future abstention does not in itself dispel the unfavorable prognosis founded on antecedents and character. Where the promise is made primarily out of fear of punishment, it does not establish the requisite prospect of reform. The judicial instruction of Art. 41 Ziff. 2 StGB is only an auxiliary measure for persons already meeting the conditions of Art. 41 Ziff. 1 StGB; it cannot be employed to confer conditional suspension on an offender who lacks the subjective prerequisites. Considerations of equal treatment also preclude allowing a financially advantageous self-restraint to replace the legal prognosis.

  1. Auszug aus dem Urteil des Kassationshofes vom 29. März 1957 i.S.

Key legal question

Whether the appellant's promise to stop driving could remove doubts about his future good conduct and justify a conditional sentence.

Extracted holding

The promise did not dispel the doubts about future conduct and did not substitute for the unfavorable prognosis based on prior life and character.

Extracted reasoning

A mere promise does not guarantee compliance; here it was made out of fear of imprisonment rather than primarily from a genuine will to reform.

Key legal question

Whether a judicial instruction could be used to support the promise and enable a conditional sentence for a defendant who does not subjectively deserve it.

Extracted holding

A judicial instruction was not available for that purpose.

Extracted reasoning

Art. 41 no. 2 StGB serves to support a person who already satisfies the conditions of no. 1; it cannot be used to make a conditional sentence possible for someone who does not meet those conditions.
