Ponzio appealed to the Federal Supreme Court in a military-tax matter. He argued, in substance, that he was in fact fit for military service and also asked for remission of the taxes due for 1953 and 1954. The court held that it was bound by the prior reform decision on fitness and therefore could not examine that question again. It further held that remission requests under Art. 96 RTM must be addressed to the cantonal authorities designated by the canton, whose decisions are not challengeable by administrative-law appeal. The appeal was therefore inadmissible.

The taxpayer must accept the tax consequences flowing from an unchallenged or binding service-status determination, even if the underlying fitness assessment is disputed.

Con l'affermazione che sarebbe disposto a ripresentarsi davanti alla CVS, il ricorrente sembra contestare la fondatezza della decisione con cui è stato dichiarato inabile al servizio militare. Nella misura in cui egli intendesse con ciò far valere di essere in realtà abile al servizio, le sue conclusioni sono irricevibili, poichè il Tribunale federale è vincolato dalla decisione di riforma e deve unicamente esaminare la questione della tassa militare. Questa sarebbe del resto dovuta quand'anche il ricorrente fosse effettivamente abile al servizio, in quanto egli non sarebbe in tale ipotesi stato dichiarato inabile a causa del servizio prestato. Così stando le cose, con i vantaggi dello scarto pronunciato a torto il ricorrente dovrebbe accettare anche gli svantaggi, come l'obbligo di pagare la tassa militare (sentenza non pubblicata 17 giugno 1955 nella causa Signorini).
Irricevibile è parimente la richiesta di condono delle tasse dovute per gli anni 1953 e 1954. Le domande di condono nel senso dell'art. 96 RTM devono infatti essere presentate alle autorità designate dal Cantone e le decisioni di tali autorità non possono essere impugnate mediante il ricorso di diritto amministrativo.
