Omnilex summary

F. Richter Cie brought a patent infringement action concerning a patent for an iron stand. Before the Federal Supreme Court, it sought to file private expert reports on appeal and to challenge the finding that the patent lacked inventive step. The court held that private expert reports are inadmissible in appeal proceedings and are not needed to substantiate a complaint of record inconsistency. It further confirmed the cantonal court's denial of patentability for lack of inventive step under the patent statute. The appeal was dismissed.

Omnilex headnote

Art. 16 Ziff. 1 PatG; inventive step as condition of patent protection; private expert reports in appeal proceedings. Private expert reports are not admissible in the federal appeal procedure to supplement the record or to attack factual findings. The party alleging factual inconsistency need not rely on an expert report for that purpose. Patent protection is to be refused where the claimed subject matter lacks inventive step; the appellate court will uphold the denial of protection when the lower court's assessment on this point is not overturned.
