Neff complained that the Landammannamt of Appenzell I. Rh. unlawfully refused him the required authorization to initiate an insult action on behalf of the Freien Appenzeller. The Federal Court rejected the objections that he lacked standing and should first have approached the Standeskommission. It held that the dispute concerned two independent insult proceedings and that Neff could not be compelled to assert his claim only as a counterclaim. The refusal was therefore an unconstitutional denial of justice, and the authority was ordered to grant the authorization.
Art. 32 Abs. 3 and cantonal constitutional complaint against refusal of authorization to sue; denial of justice where an authority refuses a required procedural permit. Standing is admitted where the complainant acts under a valid mandate from the competent committee. Prior recourse to another cantonal authority is not required absent proof that the matter falls under its supervisory competence. Separate insult proceedings involving different publications and reciprocal claims are independent; a party entitled to sue may not be compelled to litigate only by way of counterclaim in the opponent’s action. A refusal to issue the authorization in such circumstances constitutes unconstitutional denial of justice (consid. 1-3).
beschwert sich nun Neff gegen das Landammannamt wegen Rechtsverweigerung, da ihm durch Verweigerung des Rechts vorschlages verunmöglicht worden, den Injurien-Prozeß gegen die Redaktion des Appenzeller Volksfreundes einzuleiten. E. In seiner Vernehmlassung verlangt hiegegen das Land ammannamt von Appenzell I. Rh., daß auf die Beschwerde nicht eingetreten werde: 1) weil Neff zum Prozesse und zur Beschwerde nicht legitimirt sei, da Roman Sutter Präsident des Redaktionscomités des Freien Appenzeller sei und er von diesem keine Vollmacht besitze; 2) weil Neff Namens der Re daktion des Freien Appenzeller sich in erster Linie mit seiner Beschwerde an die Standeskommission von Appenzell I. Rh. hätte wenden sollen, laut Art. 30 der Landesverfassung von Appenzell I. Rh.; 3) weil die Beschwerde an und für unbegründet sei, da an die Redaktion des Volksfreundes über den sachlich gleichen Gegenstand bereits Rechtsvorschlag ertheilt gewesen sei, als Neff seinerseits den Rechtsvorschlag verlangt habe, und letzterer seine Klage als Widerklage geltend machen könne im gegnerischen Injurien-Prozesse.
