Demnach erkennt die Schuldbetr. und Konkurskammer : Auf die Beschwerde wird nicht eingetreten. 48. Auszug aus dem Entscheid vom 18. September 1922 i. S. Rofer. Pfandnachlassverfahren über einen Miteigentümer. Voraus- . setzungen. Am 14. August 1922 reichte Arnold Hofer, der zu- sammenmit Frau Burckhalter Eigentümer der Hotels Viktoria und Baumgarten in Thun ist, und zwar zu einem Drittel, bei der dortigen Nachlassbehörde (Ge- richtspräsident) das Gesuch um Bewilligung einer Nach- la!)stundung und Eröffnung des Pfandnachlassver- fahrens ein. Im Instruktionsverfahren gab der Ehemann BUrkhalter die Erklärung ab, dass er und seine Frau sieh der Eröffnung des Pfandnachlassverfahrens über Bofer widersetzen, weil sie von den Pfandgläubigern nichthedrängt werden .. .. .. .. .. .. .. .. .. s .......... .. Aus den Erwägungen: Übrigens würde der angefochtene Entscheid auch :der materiellen Prüfung standhalten. Denn der Rekurrent erklärt nicht etwa, die in Art.l6 ff. HPfNV vorgesehene Massnahme der Tilgung der rückständigen . Pfandzinse vermittelst Amortisationshypothek nicht in Anspruch nehmen zu wollen, wie denn auch angesichts der mun- haften Zinsrückstände davon auszugehen ist, das Pfand- nachlassverfahren würde ohne Durchführung . dieser Massnahme nicht zum Ziele führen können. aber die Grundpfandschulden, deren Zinsen derart getilgt werden wollen. nicht nur den Miteigentumsanteil desjenigen Miteigentümers, welcher allein die Eröffnung des Pfandnachlassverfahrens beantragt, sondern das HoteIgrundstück als solches, was hier ohne weiteres anzunehmen ist, da der Ge uchsteller ja sogar behauptet, er sei Solidarschuldner sämtlicher Grundpfandschulden, so muss auch die Amortisationshypothek auf das Grund- stück als solches gelegt werden. Dann bedarf es aber zur Errichtung dieser Hypothek als einer neuen Grund- stücksbelastung auch der Zustimmung sämtlicher Mit- eigentümer (Art. 648 Abs. 2 ZGB). Kann wegen der möglichen Verschiedenheit der Vermögensverhältnisse der Miteigentümer wohl nickt verlangt, ja vielleicht nicht einmal zugelassen werden, dass alle Miteigentümer zusammen ein einheitliches Pfandnachlassverfahren ein- leiten (vgL AS 47 III S.52 f. Erw.3), so bedarf es nach dem Gesagten doch mindestens der Zustimmung der übrigen Miteigentümer, wenn einer von ihnen das Pfand- nachlassverfahren einleiten will.
