  1. Urtheil vom 26. Oktober 1878 in Sachen Eva Förtsch. A. Mit Eingabe vom 8. August d. J. beschwerte sich Eva Förtsch über eine Verfügung der Justiz- und Polizeidirektion des Kantons Bern vom 8. Juni d. J., durch welche das Gesuch der Förtsch um Aufhebung ihrer am 13. September 1872 von der nämlichen Behörde verfügten Ausweisung aus dem Gebiete des Kantons Bern und um Gestattung des Aufenthaltes in diesem Kanton abgewiesen wurde. Sie berief sich hiefür auf Art. 2 des Niederlassungsvertrages zwischen der Schweiz und dem deutschen Reiche vom 17. April 1876, welchem durch die angefochtene Ver fügung zuwidergehandelt worden sei. B. Der Regierungsrath des Kantons Bern bestritt dem Bun desgerichte die Kompetenz, in die Beschwerde einzutreten, weil dieselbe sich auf Bestimmungen eines Staatsvertrages mit dem

Auslande, welche die Niederlassung betreffen, stütze und mithin durch Art. 59 Ziffer 10 des Bundesgesetzes über die Organi sation der Bundesrechtspflege vom 27. Juni 1874 als eine Ad ministrativsache dem Bundesrathe, beziehungsweise der Bundes versammlung zur Erledigung zugewiesen sei. Demnach hat das Bundesgericht, in Anwendung des von dem Regierungsrathe des Kantons Bern richtig angerufenen Art. 59 lemma 2 Ziffer 10 des Bundesge setzes vom 27. Juni 1874, erkannt: Auf die vorliegende Beschwerde wird hierorts wegen Inkom petenz nicht eingetreten und der Petentin überlassen, sich an den Bundesrath zu wenden.
