Maurer challenged the expropriation award and asked the Federal Court to add a separate CHF 2,000 compensation item for the upper water power. The court held that the water power was not automatically included as an accessory of the demolished stamp mill and that the company did not have to buy it unless continued use would be impossible or overly burdensome, which experts excluded. It therefore confirmed that the water power remained with Maurer, but it upheld and reformulated the compensation: CHF 3,000 for the stamp building and CHF 1,000 for inconveniences and rebuilding costs, with 5% interest from 1876-06-14. The company was also given an option to acquire the water right for CHF 2,000, in which case related duties fell away.

A water power employed for a stamp mill does not, merely as a pertinenz, necessarily follow the fate of the expropriated building. Acquisition by the expropriating undertaking is required only where continued use by the owner is impossible or substantially impaired; if the right can still be exercised on substitute land made available, no compulsory taking exists (consid. 2-3). Nevertheless, the expropriated party is entitled to equitable compensation for consequential disadvantages and rebuilding costs. Where the parties so agree, the court may allow the expropriator an elective right to acquire the use right against a fixed payment, with the related substitute obligations then falling away (consid. 4).
B. Diesen Antrag nahm die Eisenbahngesellschaft an; dage gen verlangte M. Maurer den Entscheid des Bundesgerichtes und es trug dessen Vertreter heute darauf an, es möchte in Zif fer 1 noch das Dispositiv neu aufgenommen werden, die Nord ostbahn sei schuldig, an ihn zu bezahlen 2000 Fr. nebst Zins zu 5% von Martini 1875 an unter Kostenfolge. Der Vertreter der Nordostbahn trug auf Verwerfung dieses Begehrens und auf Bestätigung des Antrages des Instruktions richters an. Das Bundesgericht zieht in Erwägung:
