The appellant challenged a bankruptcy warning issued on the basis of a payment order. The Federal Chamber held that the debtor copy established that the payment order had been addressed to her husband, not to her as the firm owner, so the legal basis for the bankruptcy warning was absent. It further held that supervisory authorities must conduct an official inquiry and obtain the enforcement files; the debtor copy could therefore be considered on appeal even though it had not been before the cantonal authority. The appeal was upheld and the bankruptcy warning annulled.

The supervisory authority may not decide solely on the parties’ submissions, but must ex officio procure the relevant enforcement acts; these form part of the complaint record. If the lower authority failed to request them, the appellant may still produce the missing enforcement documents before the Federal Tribunal, and such documents are not excluded as inadmissible nova; the appellate authority may rely on them and, if necessary, itself order production of the missing file (consid. 2). Where the debtor copy shows that the payment order was addressed to another person, the prerequisite for a bankruptcy warning is lacking (consid. 1).
daß die Forderung die im Handelsregister eingetragene Firma A. Degenhardt Lötscher und nicht den in der Firma als Prokurist tätigen Ehemann Albert Degenhardt betreffe. Gestützt darauf wies die kantonale Aufsichtsbehörde die Beschwerde als unbegründet ab, da der Konkursandrohung ein auf die Firmainhaberin lau tender Zahlungsbefehl vorausgegangen und dieser ihr vom Brief träger persönlich zugestellt worden sei. C. Gegen diesen Entscheid hat Frau Degenhardt Lötscher unter Erneuerung ihres Begehrens innert Frist an das Bundes gericht rekurriert. Dem Rekurs liegt das Schuldnerdoppel des Zahlungsbefehls bei mit der Adresse: An Herrn A. Degen hardt Lötscher , worauf die Rekurrentin ausdrücklich hinweist, mit dem Beifügen, die kantonale Aufsichtsbehörde sei offenbar vom Betreibungsamt nicht genügend oder unrichtig unterrichtet worden. Die kantonale Aufsichtsbehörde stellt fest, daß das Schuldner doppel des Zahlungsbefehls der Beschwerde an die kantonale In stanz nicht beilag und daß auch aus den Akten des Betreibungs amtes sich nicht ergeben habe, daß es an Herrn A. Degenhardt Lötscher adressiert war. Es sei daher als novum zurückzuweisen. Die Schuldbetreibungs und Konkurskammer zieht in Erwägung:
