  1. Arteil vom 17. Dezember 1909 in Sachen Beck, Kl. u. Ber. Kl., gegen Briefmarkenautomatengesellschaft Plüß, Bekl. u. Ber. Kl. Erledigung einer Berufungsstreitsache durch Abstandserklärung der berufungsbeklagten Partei (der in der Beklagtenrolle stehenden Konkursmasse einer Genossenschaft zufolge Aufhebung des Kon kurses mangels Aktiven). Feststellung der Anerkennung des geg nerischen Anspruchs (der Klageforderung). Das Bundesgericht hat, nachdem sich aus den Akten ergeben hat: Der Kläger G. Beck hatte gegen die Genossenschaft Briefmar kenautomatengesellschaft Plüß in Zürich I eine Klage auf Be zahlung von 3000 Fr. nebst Zins zu 5% seit dem 24. April 1908 angehoben, welche Klage von den beiden kantonalen In stanzen als unbegründet abgewiesen worden ist. Gegen das am
  2. Mai 1909 gefällte Urteil der obern Instanz (der I. Appella

tionskammer des zürcherischen Obergerichtes) hat der Kläger gültig die Berufung an das Bundesgericht ergriffen und sein Klagebe gehren erneuert. In der Folge wurde über die beklagte Genossen schaft der Konkurs eröffnet, worauf der Bundesgerichtspräsident durch Verfügung vom 26. Oktober 1909 das Berufungsverfahren bis zum Beschlusse der Gläubigerversammlung über die Aufnahme des Prozesses eingestellt hat. Am 27. November 1909 hat das Konkursamt Zürich dem Bundesgerichte mitgeteilt, daß das Kon kursverfahren über die beklagte Genossenschaft mangels Aktiven aufgehoben worden sei und daß der Prozeß deshalb nicht weiter geführt werde. Der Instruktionsrichter hat darauf durch Verfü gung vom 6. Dezember 1909 den Vertreter des Berufungsklägers eingeladen, allfällige durch die konkursamtliche Erklärung vom 27. November veranlaßte Anträge innert 8 Tagen zu stellen unter Androhung des Ausschlusses. Auf dies hat der genannte Vertreter mit Schreiben vom 11. Dezember 1909 erklärt: Der Prozeß möge analog dem einen ähnlichen Fall betreffenden bun desgerichtlichen Beschluß vom 3. Dezember 1892 (AS 18 Nr. 144), als durch Anerkennung der Klage abgeschrieben werden unter Überbindung sämtlicher Gerichtskosten an die Beklagte; in Erwägung: Der Kläger stellt das Begehren, der Prozeß möge abgeschrieben werden, weil die Konkursmasse der beklagten Genossenschaft die Klage anerkannt hat. Diesem Begehren ist zu entsprechen. Frei lich sind Fälle denkbar, wo der Kläger ein Interesse daran haben kann, sich bei der Abstandserklärung der Gläubigerschaft nicht zu beruhigen, sondern gegenüber dem Beklagten selbst ein kondem natorisches Urteil zu erwirken; und im allgemeinen darf deshalb eine Klage, die von der Konkursmasse des Beklagten anerkannt worden ist, nicht ohne Zustimmung des Klägers als erledigt ab geschrieben werden. Anders aber, wenn der Kläger selbst die Ab schreibung der von der Konkursmasse anerkannten Klage verlangt und wenn es sich, wie hier, um eine Genossenschaft handelt, deren. Konkurs mangels Aktiven aufgehoben worden ist. Alsdann ist natürlich auch der Kläger an der Weiterführung des Prozesses in keiner Weise mehr interessiert. In der Kostenfrage ist davon auszugehen, daß der Prozeß infolge einer Abstandserklärung auf beklagtischer Seite beendigt wird. Danach sind grundsätzlich die Gerichtskosten von der Be klagtschaft zu tragen (Art. 24 BCP)...; erkannt:

  1. Das Geschäft wird als durch Anerkennung der Klage er ledigt abgeschrieben.
  2. Die Gerichtskosten aller Instanzen erliegen auf der Be klagten.
