Omnilex summary

In a divorce dispute between Studer and Studer, the excerpt addresses the Federal Court's competence to rule on the ancillary consequences of divorce. The court rejects its more recent restrictive approach and returns to its earlier case law, holding that it may decide the ancillary consequences itself when reviewing the divorce judgment, because the divorce judge is generally empowered to rule on those consequences together with the divorce under Art. 49 para. 2 ZEG.

Omnilex headnote

Art. 49 paras. 1-2 ZEG; Arts. 56-57 OG; competence of the Federal Court regarding the ancillary consequences of divorce. The Federal Court may, when seized of a divorce appeal, also adjudicate the ancillary consequences if it modifies the cantonal divorce dispositive or the finding on fault. The ancillary consequences are not to be treated as a separate matter excluded from federal review merely because they involve the application of cantonal law; rather, they form part of the divorce judgment as a whole, which the divorce judge is generally called upon to determine ex officio or upon request. The earlier restrictive case law is abandoned and the prior practice restored.

Key legal question

Whether the Federal Court has jurisdiction to review and decide the ancillary consequences of a divorce under Art. 49 paras. 1-2 ZEG and Arts. 56-57 OG.

Extracted holding

The Federal Court may itself determine the ancillary consequences of the divorce when deciding the divorce decree or when changing the cantonal divorce dispositive, including where it must reassess issues such as fault.

Extracted reasoning

The court departs from its recent denial of competence under Art. 56 OG. It reasons that, under Art. 49 para. 2 ZEG, the divorce judge is generally instructed to decide the ancillary consequences together with the divorce itself; therefore the Federal Court may also decide them on appeal as part of reviewing and, if necessary, altering the divorce dispositive.
