Meyrat challenged a Basel-Landschaft measure by which he was threatened with detention unless he paid outstanding court costs from a 1873 conviction. The Federal Court held that court costs are a state debt, not a penalty, and that debtor detention as an enforcement method was unconstitutional after the Federal Constitution came into force. The coercive collection was therefore unlawful and the deposited amount had to be refunded. The compensation request for 300 francs was not heard, the Court lacking jurisdiction over this civil claim below the statutory threshold.
Art. 59 BV; court costs and debtor detention; enforcement of state claims. Court costs do not constitute punishment but a public-law debt of the convicted person to the state; their conversion into detention is inadmissible under Art. 59 BV. From the entry into force of the constitutional rule, debtor detention is excluded as an enforcement measure, and public-law execution follows the law then in force. A payment made under unconstitutional coercion may be reclaimed. Civil compensation claims below the federal jurisdictional limit remain for the ordinary civil courts (consid. 1-3).

Die Regierung von Baselland machte in ihrer Vernehmlas sung, in welcher sie auf Abweisung der Beschwerde antrug, geltend, das Anhalten des Meyrat und die Abforderung der schuldigen Ko sten enthalte keine Verfassungsverletzung, indem Meyrath auf die bloße Androhung hin, daß er zum Abverdienen der Kosten müßte angehalten werden, bezahlt habe. Allein derselbe hätte auch kein Recht zur Beschwerde, wenn er wirklich in Haft gesetzt worden wäre, weil das wegen Diebshehlerei über ihn gefällte Urtheil bereits am 29. November 1873 gesprochen worden sei und Meyrat auch die zu der Abverdienung der Kosten nothwendige Zeit vor Inkraft treten der Bundesverfassung hätte absitzen müssen, wenn die Polizei direktion ihn nicht auf seinen Wunsch zwei Male vorübergehend entlassen hätte. Im Fernern bilden die Kosten einen Theil der Strafe, indem sie durch den Verbrecher veranlaßt und oft wegen ihres bedeutenden Betrages bei Ausmessung des Strafmaßes berück sichtigt werden. Endlich könne Meyrat an seinem gegenwärtigen Wohnsitze in Basel nicht belangt werden, weil er fallit und daher von ihm nichts erhältlich sei. Das Bundesgericht zieht in Erwägung:
