Rudolf Rhyn had obtained a monetary award and lifelong annuity against Wüthrich Cie. from the Bern Appellations and Cassation Court. Wüthrich Cie. appealed to the Federal Court, asking only for an unspecified reduction of the lump sum and annuity, and separately challenging the interest start date. The Federal Court held that Art. 67(2) Org. Ges. requires the notice of appeal to state precisely, preferably in figures, to what extent the judgment is challenged and what modifications are sought. Because the appellant had not quantified the requested reductions, the appeal was legally ineffective; the accessory interest issue could not be examined either.

Die Berufungserklärung muß die angefochtene Tragweite des kantonalen Urteils und die beantragten Abänderungen möglichst genau und ziffermäßig bezeichnen, damit Bundesgericht und Gegenpartei den noch streitigen Betrag erkennen können (vgl. auch Art. 54 Org.-Ges.). Bloße Begehren auf 'angemessene Herabsetzung' genügen bei Schadenersatz- und ähnlichen Ansprüchen nicht. Fehlt es daran in der Hauptsache, so kann auf einen bloß akzessorischen Punkt nicht eingetreten werden.
