Hans Keßler and other bankruptcy creditors challenged the Basel enforcement office's notice of auction for three parcels previously transferred by the bankrupt Reinhard Schilling to I. B. Wohler. They argued that the office had not complied with the statutory deadlines and that the auction should at least be postponed until a pending avoidance action was decided. The cantonal supervisory authority dismissed the complaint for lack of standing, and the Federal Tribunal confirmed that result. It held that the creditors had no legally protected interest in preventing the auction, because the realization was a separate enforcement proceeding concerning property formally owned by the third party.
Art. 151 and 153 SchKG; standing to complain against auction measures concerning pledged real estate: the debtor and, where relevant, the third-party owner are entitled to invoke violations of the provisions governing pledged-property enforcement. Bankruptcy creditors who are not directly affected lack standing to complain merely because the pledged object may produce a surplus for the estate or because they wish to await the outcome of a parallel avoidance action. The existence of a possible economic interest in a postponed sale does not constitute a legally protected interest in the annulment of the auction notice; realization of the pledge proceeds in a separate enforcement procedure outside the bankruptcy estate (consid. ...).
Der Rekurs wird abgewiesen. erkannt: Demnach hat die Schuldbetreibungs und Konkurskammer führern gegenüber nicht vor. bungs und Konkursamtes Baselstadt liegt also den Beschwerde thekarbank zurücktreten. Ein gesetzwidriges Vorgehen des Betrei der in erster Linie und direkt als Gläubigerin beteiligten Hypo der Rekurrenten an der Verschiebung der Gant vor demjenigen Rechtes auf Durchführung der Betreibung muß jenes Interesse gesichts dessen und namentlich des der letztern Partei zustehenden dern daß auch die betreibende Gläubigerin dieselbe verlangt. An eigentümer mit der sofortigen Verwertung einverstanden ist, son zu können. Aber dem steht gegenüber, daß nicht nur der Dritt bei einem Verkaufe für Rechnung der Masse als Bieter auftreten schiebung der Steigerung interessiert sein können, so etwa, um Es ist nun freilich möglich, daß die Rekurrenten an der Ver des Bundesgerichtes, Bd. XXIII, Nr. 250 i. S. Schwegler). andere Drittpartei zur Beschwerde legitimiert (vergl. Entscheid. Schuldner, nicht aber der Dritteigentümer des Pfandes oder eine auf Pfandverwertung betreffenden Vorschriften nur der betriebene derholt erkannt wurde, ist bei Mißachtung dieser die Betreibung Art. 151 und 153 B. G. verletzt worden seien. Denn wie wie daß bei Ansetzung der Liegenschaftsgant die Bestimmungen der
