  1. Urteil vom 16. November 1898 in Sachen Schmid gegen Appenzell J. Rh. Erlöschen der Altersvormundschaft ipso jure. Entmündigung Volljähriger Der im Jahre 1870 geborene W. Schmid, Schuster, von Appenzell, in Emmen, Kantons Luzern, rekurrierte an das Bun desgericht gegen einen Beschluß von Landammann und Standes kommission des Kantons Appenzell J. Rh., wonach er unter Vormundschaft bleiben sollte. Der angefochtene Beschluß stützt sich lediglich darauf, der Rekurrent besitze nicht die nötige Gewähr für eigene und selbständige Verwaltung seines Vermögens. Der Re kurrent war s. Z. lediglich als minderjährig nach dem Tode seines Vaters unter Vormundschaft gestellt worden. Das Bundesgericht zieht in Erwägung.
  2. Nach den eigenen Erklärungen der Standeskommission ist die Vormundschaft, deren Aufhebung der Rekurrent begehrt, seiner Zeit lediglich wegen Minderjährigkeit ausgesprochen worden. Nun bestreitet die Standeskommission selbst nicht, daß der Rekurrent inzwischen großjährig geworden sei. Danach erlosch aber die über ihn verhängte Altersvormundschaft ohne weiteres mit dem Zeit punkt der erreichten Volljährigkeit, d. h. mit dem zurückgelegten zwanzigsten Altersjahre (Art. 1 des Bundesgesetzes betreffend die persönliche Handlungsfähigkeit); eines besondern Aufhebungs beschlusses bedurfte es nicht, und insbesondere stand es der Stan deskommission nicht etwa zu, die Charakterreife des Rekurrenten zu prüfen und ihn je nach dem Ausfalle dieser Prüfung noch weiterhin unter Vormundschaft zu belassen. Vielmehr will das Gesetz, indem es den Zustand der Handlungsfähigkeit mit einem bestimmten Altersjahre eintreten läßt, gerade ein allgemeines, abstraktes Kriterium aufstellen, das dem Ermessen der Vormund schaftsbehörden keinen Raum läßt (vergl. Urteil des Bundes gerichts vom 26. Oktober 1883 i. S. Schnellmann, Amtl. Slg., Bd. IX, S. 482 Erw. 1). Über Volljährige aber ist die Ver hängung der Vormundschaft nur unter den in Art. 5 des ge nannten Bundesgesetzes normierten Voraussetzungen zulässig (Art. 8 eod.).
  3. Daß diese Voraussetzungen vorlägen, ist nun von der Standeskommission zwar angedeutet worden, allein es ist diese Behauptung heute nicht zu hören. Denn es steht fest, daß eine Entmündigung aus einem dieser bundesrechtlich zulässigen Bevor mundungsgründe gar nicht eingeleitet worden ist. Eine Beschrän kung der Handlungsfähigkeit Volljähriger ist aber nur nach einem vorausgegangenen Entmündigungsverfahren zulässig, und da ein solches nicht stattgefunden hat und der Rekurrent, wie gesagt, volljährig ist, muß die bestehende Vormundschaft als aufgehoben erklärt werden und sind die Vormundschaftsbehörden verpflichtet, dem Rekurrenten sein Vermögen auszuhändigen. Demnach hat das Bundesgericht erkannt: Der Rekurs wird als begründet und die über den Rekurrenten bestehende Vormundschaft als aufgehoben erklärt.
