Seb. Crivelli Cie. applied on behalf of Josef Felchlin for his release from Swiss citizenship and transfer of his warded assets. After the Waisenamt Steinen and the Schwyz government refused the request, the matter was brought to the Federal Court through the Federal Council. The court held that disputes over waiver of Swiss citizenship are for the Federal Court alone, that the statutory objection procedure had not been shown to have been followed, and that the proof of capacity under the law of the country of domicile was still missing. It annulled the cantonal decision and remanded the case for proper transmission of the waiver declaration and objection period.
Art. 7 of the federal citizenship act; waiver of Swiss citizenship and competence to decide objections: the declaration of renunciation, with the required documents, must first be submitted to the cantonal government, which merely transmits it to the commune authority for notification of possible interested parties and for a four-week objection period; disputes over the admissibility of the waiver are decided exclusively by the Federal Court (consid. 1–4). A decision rendered by communal or cantonal authorities on the waiver itself is incompetent and must be set aside. In addition, the applicant must furnish the proof of capacity required by Art. 6 lit. b, namely capacity under the law of the country of domicile (consid. 5).
