The Federal Court dealt with a constitutional complaint brought by the mother’s relatives and the divorced mother against a Zug guardianship order requiring the children to be delivered to their guardian. The Court held that a custody award in a divorce judgment does not prevent cantonal guardianship authorities from intervening under cantonal law when parental duties are insufficient. It further held that the constitutional guarantees invoked did not bar such child-protection measures, and that the alleged denial of hearing was not established. The complaint was dismissed.
