Refusal to admit professional counsel in district court

BGE 1 I 6Federal Supreme Court Official Reports (BGE) / Band ISep 23, 1875Dismissed

Summary

Sutter, acting for widow Inauen, complained to the Standeskommission that the district court’s refusal to admit a professional advocate constituted denial of justice and violated equality. The Standeskommission replied on 5 June that, in light of the cited statutory provision, it could not require the district court to allow such counsel. The complaint was therefore not successful.

Regest

Professional representation; statutory restriction on admission of advocates. Where a cantonal authority refers to an express legal provision limiting the use of professional counsel before a district court, a supervisory complaint alleging denial of justice and inequality fails if the complainant seeks to compel the court to admit such an advocate contrary to that rule.
