C. Gerichtsentscheide 3093, 3094 3093 Betreibungsverfahren. Über die Anrechenbarkeit ausseramtlicher Zah­lungen des Schuldners entscheidet im Streitfall der Richter (Art. 85 Sch KG). Nach feststehender Praxis ist die Frage, ob eine ausseramtliche Zahlung oder Ersatzleistung an eine Betreibungsforderung anzurechnen sei, im Streitfall nicht von der Aufsichtsbehörde, sondern vom Richter zu entschei­den; BGE 72 III7; Entscheid der Aufsichtsbehörde Basel-Land vom 17. Au­gust 1960 in «Blätter für Schuldbetreibung und Konkurs» 1962, S. 145; vgl. dieselbe Zeitschrift 1955, S. 105-108 (Aufsichtsbehörde St.Gallen), 1956, S. 14 (Aufsichtsbehörde Graubünden). Es ist vielmehr Sache des Zivilrichters, über diese Frage zu entscheiden. Der Schuldner kann beim Bezirksgerichtspräsidenten am Ort der Betrei­bung die Einstellung des Verfahrens verlangen; Art. 85 SchKG in Verbin­dung mit Art. 34 Ziff. 6, 10 Ziff. 5 und 223 Abs. 1 ZPO1. Nach Zahlung der betriebenen Forderung steht ihm das Recht zu, auf Rückerstattung zu kla­gen; Art. 86 SchKG. Solange die richterliche Einstellung nicht rechtskräftig verfügt ist, hat die Betreibung ihren Fortgang zu nehmen, und die Auf­sichtsbehörde hat über das Bestehen der Forderung nicht zu befinden. Die Frist zur Stellung des Pfän­dungsbegehrens verlängert sich um die Dauer des Rechtsöffnungsverfah­rens (Art. 88 Abs. 2 SchKG). Nach Art. 88 Abs. 2 SchKG erlischt das Recht zur Stellung des Pfändungs­begehrens mit Ablauf eines Jahres seit der Zustellung des Zahlungsbe­fehls.
