C. Gerichtsentscheide 3064 3064 Gerichtsstand. Wohnsitzwechsel nach Stellung des Vermittlungsbegeh­rens (Art. 39 ZPO1). Der Beklagte hatte seinen Wohnsitz während des Vermittlungsverfahrens gewechselt und in einen andern Kanton verlegt. Aus bundesrechtlichen Überlegungen und Gründen der interkantonalen Rechtsvergleichung war das Bezirksgericht auf die Klage nicht eingetreten. Das Obergericht er­kannte auf Eintreten und wies die Streitsache zur materiellen Behandlung an die Vorinstanz zurück. Der Schuldner, der in der Schweiz einen festen Wohnsitz hat, muss für persönliche Ansprachen vor dem Richter seines Wohnsitzes gesucht werden; Art. 59 BV. Es fragt sich, ob die genannte Vorschrift der Bundes­verfassung auch den massgebenden Zeitpunkt für die Begründung des Gerichtsstandes festlegt. Das ist zu verneinen. Die Bundesverfassung über­lässt die Festsetzung dieses Zeitpunktes vollständig dem kantonalen Recht. Die ausserrhodische Zivilprozessordnung erklärt die rechtsgültige Anru­fung des Vermittlers als massgebend für die Begründung der örtlichen Zuständigkeit; Art. 39 ZPO1. Sie steht mit dieser Lösung nicht allein. In ähn­licher Weise lässt § 294 Abs. 3 der bern. ZPO die Rechtshängigkeit bereits mit dem Gesuch um Ladung des Beklagten zum Aussöhnungsversuch ein- treten. Die staatsrechtliche Kammer des Schweiz. Bundesgerichts hat in einem analogen Streitfall mit Urteil vom 10. Februar 1922 ausdrücklich erklärt, dass das Prozessrecht des Kantons, in dem der Prozess geführt wird, darüber zu entscheiden habe, durch welche Handlungen der Prozess einzuleiten sei und mit welchem Augenblick der Gerichtsstand festgelegt werde; BGE 48 1196.
